Think every business can jump into ChatGPT Ads? Think again.

ChatGPT Ads are creating a new opportunity for businesses to reach people while they explore products, compare options, and make decisions. However, OpenAI does not treat every advertiser or industry the same.

Its current ChatGPT ad policies place strict restrictions on several sensitive, regulated, and high-risk categories. OpenAI can review the advertiser, creative, landing page, and the type of conversation where an advertisement could appear. The current policy also explains that restricted categories such as financial services, healthcare, and legal services may require additional review or eligibility requirements.

For marketers interested in the platform, understanding these restrictions is just as important as understanding how the ads work. If you are new to the channel, Elite’s guide to ChatGPT Ads and what businesses need to know provides a broader introduction to the opportunity.

So, which industries face the biggest restrictions?

1. Adult Content and Dating Businesses

Adult-oriented businesses face some of the clearest ChatGPT ad restrictions.

OpenAI currently prohibits advertising for dating apps, sexual services or products, adult companion websites, adult-themed events, sexual health products, full nudity, and sexually suggestive or explicit advertising.

There are limited exceptions. Lingerie, underwear, and swimwear may be permitted when presented in a standard retail or fashion context without sexually suggestive positioning.

For businesses built primarily around dating or adult services, ChatGPT Ads are currently not an available acquisition channel.

2. Alcohol and Tobacco Businesses

Alcohol and tobacco advertising is also prohibited.

According to OpenAI’s official advertising policy, ads cannot promote or facilitate the sale, use, or consumption of alcoholic beverages, cigarettes, vaping products, nicotine products, or alcohol and tobacco-focused activities.

The landing page matters too.

An otherwise acceptable advertisement could still be rejected if its destination introduces prohibited products. OpenAI applies its standards across the full advertising experience, including the creative and destination page.

3. Recreational Drug and Cannabis Businesses

Most recreational cannabis and drug-related businesses also remain unable to advertise.

OpenAI prohibits ads promoting substances intended to intoxicate or alter consciousness, including marijuana, THC products, psychedelic substances, magic mushrooms, and related paraphernalia.

Some non-intoxicating hemp-derived products may qualify. OpenAI gives THC-free CBD topicals and hemp clothing as examples of products that may be permitted when they do not promote intoxicating use.

For recreational cannabis brands, however, ChatGPT Ads remain highly restricted.

4. Gambling and Sports Betting Companies

Casinos, sportsbooks, lotteries, poker platforms, and similar businesses built around real-money wagering also face major restrictions.

OpenAI currently prohibits advertisements involving wagers on games of chance, skill, or uncertain outcomes. That includes online sports betting, casino promotions, lotteries, and gaming platforms that offer cash prizes.

There are some exceptions depending on what is actually being advertised.

A casino resort may promote lodging, travel, or entertainment when gambling is not the focus of the campaign. Digital games that do not involve real-money wagering or cash prizes may also qualify.

This makes the actual offer behind the advertisement extremely important.

5. Political Campaigns and Advocacy Organizations

Political advertising remains prohibited on ChatGPT.

OpenAI does not currently allow ads advocating for or against political candidates, political parties, elections, public policy, government action, referendums, or contested social issues.

The platform also limits advertisements around certain sensitive conversation types.

For political campaigns and advocacy organizations, ChatGPT cannot currently be approached as another conventional political advertising platform.

6. Legal Services Outside the U.S. and Unqualified Legal Advertisers

This category has changed substantially since ChatGPT Ads first launched.

Legal services are no longer universally prohibited.

OpenAI now permits legal advice, representation, and legal-service advertising in the United States when the advertiser is licensed to practice law in the jurisdiction where the advertisement appears. Its policy specifically includes areas such as personal injury, immigration, legal claims, and document preparation. Eligible U.S. legal advertisers still require OpenAI’s approval through manual, case-by-case review.

Legal-service advertising outside the United States remains prohibited under the current policy.

That creates an important distinction for law firms. A properly licensed U.S. personal injury firm may qualify, while an advertiser without the appropriate license or a firm advertising legal services outside the U.S. may not.

This is particularly relevant for firms exploring emerging acquisition channels. Elite recently covered how ChatGPT advertising is changing digital advertising strategy and why conversational context may require a different approach than traditional paid search.

7. Individual Housing and Job Listings

Real estate and recruitment advertisers also need to pay close attention to the difference between promoting a platform and promoting one specific opportunity.

OpenAI prohibits advertisements for individual job listings and individual housing rentals or sales.

However, advertisers may promote platforms containing multiple housing or employment listings as long as the advertisement and landing page do not reference a specific listing.

For example, a general job-search marketplace may qualify. An ad promoting one specific position would not.

8. Certain Financial and Healthcare Businesses

Financial services and healthcare require the most careful explanation because neither industry is completely prohibited.

In the United States, OpenAI may approve certain financial advertisers on a case-by-case basis. Eligible categories can include credit cards, mortgages, insurance, deposit accounts, investment services, personal loans, payment services, financial planning, and auto loans. Advertisers may also be required to provide proof of licensure.

However, OpenAI does not allow advertisements for credit repair, debt settlement, debt assistance, and certain alternative investments. Financial-service advertising outside the U.S. is generally prohibited under the current policy.

Healthcare follows a similar restricted model.

OpenAI says regulated medical products, services, and treatment-related claims are restricted, while some U.S. healthcare advertisers may qualify through case-by-case approval.

For businesses in either industry, approval should never be assumed simply because the product or service is legal elsewhere.

Health-service advertising outside the United States is generally prohibited.

Why ChatGPT Ad Restrictions Matter

One of the biggest mistakes marketers can make is assuming that approval on Google Ads or Meta automatically means approval on ChatGPT.

OpenAI evaluates more than the advertisement itself.

Its Advertising Terms state that campaigns are subject to OpenAI’s acceptance and that the company may review, reject, remove, modify, pause, or terminate advertisements or advertisers when necessary.

OpenAI also reviews advertiser eligibility, landing pages, campaign materials, and compliance with its policies. Restricted categories can require additional verification or manual review.

That means marketers should evaluate three major areas before launching:

  1. Whether the advertiser itself is eligible
  2. Whether the creative and landing page comply with policy
  3. Whether the campaign is appropriate for the conversations where it may appear

OpenAI’s guidance for creating ChatGPT Ads also recommends clear, specific, benefit-focused messaging and multiple creative variations instead of simply transferring a traditional keyword campaign into ChatGPT.

Elite’s own ChatGPT Ads guide for businesses goes deeper into how conversational intent, geographic targeting, landing pages, and conversion tracking can influence campaign strategy.

Before Running ChatGPT Ads, Check Your Industry

ChatGPT advertising is developing quickly, and the rules have already evolved.

Legal advertising is a clear example. OpenAI’s policy history shows that its August 2026 update changed the platform to permit qualifying U.S. legal-service advertisers, while later updates continued refining the broader advertising policy.

For businesses, the lesson is simple: check the current policy before building the campaign.

Do not assume that an industry is permanently prohibited or automatically eligible. Review the advertiser requirements, landing page, creative, jurisdiction, and current OpenAI policies before investing significant time or budget.
