
Think every business can jump into ChatGPT Ads? Think again.
ChatGPT Ads are creating a new opportunity for businesses to reach people while they explore products, compare options, and make decisions. But OpenAI is not opening the platform to every type of advertiser.
Its current ChatGPT ad policies place strict limits on several sensitive and regulated categories. OpenAI can review the advertiser, the creative, the landing page, and even the type of conversation where an ad could appear.

So, which industries could find themselves locked out?

Dating apps and adult-oriented businesses face some of the clearest ChatGPT ad restrictions.
OpenAI currently disallows advertising for dating apps, sexual services or products, adult companion websites, adult-themed events, sexual health products, and sexually explicit content.
There are limited exceptions. Standard retail ads for lingerie, underwear, or swimwear may be permitted when they appear in a normal fashion or retail context and are not sexually suggestive.
For businesses built primarily around adult services or dating, ChatGPT Ads are currently not an available acquisition channel.
Alcohol and tobacco brands also face a direct restriction.
OpenAI prohibits ads promoting or facilitating the sale, use, or consumption of alcoholic beverages, cigarettes, vaping products, nicotine products, and alcohol or tobacco-focused activities.
The rule also applies to the page behind the ad.
That means a general food-delivery advertisement could still be rejected if the landing page introduces prohibited alcohol delivery. OpenAI specifically reviews ads and landing pages as part of the same advertising experience.
Cannabis and recreational drug businesses also face significant restrictions.
OpenAI currently disallows advertising for products intended to intoxicate or alter consciousness, including marijuana, THC products, psychedelics, magic mushrooms, and related paraphernalia.
Some non-intoxicating hemp-derived products may qualify. For example, certain CBD topicals with no THC may be permitted when they do not promote intoxicating use.
For most recreational cannabis businesses, however, ChatGPT Ads are currently off the table.
Casinos, online sportsbooks, lotteries, poker platforms, and similar businesses cannot advertise products or services centered on wagering money.
OpenAI currently prohibits advertising involving games of chance, skill, or uncertain outcomes when real money or cash prizes are involved.
There is an important exception.
A casino resort may advertise lodging, travel, or entertainment when gambling is not the focus of the campaign. Similarly, digital games without real-money wagering or cash prizes may still qualify.
That distinction makes the actual offer being promoted extremely important.
Political campaigns will not be able to treat ChatGPT like another traditional digital advertising platform.
OpenAI currently prohibits ads advocating for or against political candidates, political parties, elections, referendums, public policy, government action, and certain contested social issues.
OpenAI also says ads do not appear around certain sensitive or inappropriate conversations, including political content.
That means the restrictions apply to both the advertisement itself and the context where an ad could appear.
Legal advertisers face major limitations too.
OpenAI currently states that ads for legal advice, representation, or legal services offered to individuals or businesses are not permitted. That includes areas such as immigration services, personal injury representation, legal claims, and document preparation.
Legal education is different.
LSAT preparation, legal publications, podcasts, and other educational resources may qualify when they are not offering legal services.
For law firms evaluating AI advertising, the distinction between legal education and legal representation is essential.
Real estate and recruitment marketers also need to pay close attention to the rules.
OpenAI prohibits ads for individual job listings and individual housing rentals or sales.
However, a platform containing multiple jobs or housing listings may still advertise as long as the ad and landing page do not promote one specific listing.
For example, a general job-search platform may qualify, while an advertisement for one specific open position would not.
This policy was clarified in OpenAI’s August 10, 2026 update.
This category requires the most careful explanation.
Financial services and healthcare are not universally banned from ChatGPT Ads. OpenAI says some approved advertisers in these categories may qualify through manual, case-by-case review.
Financial advertisers in the United States may potentially be approved for products such as credit cards, mortgages, insurance, investment services, deposit accounts, payment services, personal loans, and financial planning.
However, OpenAI does not allow ads for areas such as credit repair, debt settlement, debt assistance, and certain alternative investments. Financial services outside the United States are generally prohibited under the current policy.
Healthcare follows a similar model.
Some advertisers may qualify for areas such as dental services, hospitals, urgent care, medical testing, consumer medical devices, vision products, and health insurance. But ads involving unsafe products, unsupported treatment claims, experimental treatments, high-risk procedures, or advertising that exploits health concerns remain prohibited.
OpenAI also states that some sensitive or regulated advertisers may be eligible only when they meet strict requirements.
The biggest mistake a marketer can make is assuming that approval on Google Ads or Meta automatically means approval on ChatGPT.
OpenAI reviews the advertising experience at three levels:
Its systems can reject ads when the advertiser, messaging, imagery, destination page, or placement fails to meet policy requirements.
OpenAI also recommends that advertisers keep messaging useful, accurate, and clearly connected to what the product actually offers. Its guidance for creating ChatGPT Ads specifically encourages distinct creative, clear value, and honest representation.

ChatGPT advertising is still developing, which means today’s rules may not be permanent.
OpenAI’s current ad policy was updated on August 10, 2026, and the company says eligible categories may expand as its review systems and compliance infrastructure mature.
At the moment, OpenAI is primarily supporting consumer categories such as household goods, local services, travel and entertainment, digital products, and education.
ChatGPT Ads are also expanding geographically. OpenAI announced on August 11, 2026 that the advertising program had launched in the United Kingdom, Mexico, Brazil, Japan, and South Korea in addition to its earlier U.S. test.
For businesses, the lesson is simple: check the rules before building the campaign.
